Terms and Conditions

1. Terms Overview

This site is subject to the following terms and conditions. By proceeding to view this Site you will be deemed to have read and accepted these terms and conditions. No other terms shall apply. These terms may be varied by Home Sale Online from time to time and the revised terms will be deemed to apply at the relevant time.

2. Contract

By payment and commencement of advertising, the terms and conditions set out within our sellers contract become binding. If you have ordered one of our packages, please review the terms via the "Property Seller" tab above.

3. Right to alter material

Home Sale Online reserves the right to alter or delete material from the Site at any time and may, at any time, revise these terms without notice by updating this section.

4. Site Information given in good faith

The information in this Site, in either text or photographic format, is given in good faith and for general information and interest only. Home Sale Online uses reasonable efforts to only include accurate information in the Site it makes no warranties or representations as to the accuracy of any information given. Home Sale Online assumes no responsibility for any errors or omissions in the content of the Site.

5. Site Information not advice or recommendation

The information in this Site, in either text or photographic format, should not be relied on and does not constitute any form of advice or recommendation. By using this Site you confirm that you have not relied on any such information. Any arrangements made between you and any third party named or referred to on the Site are entirely at your sole risk and responsibility.

6. Contractual Relationships

Nothing on this Site is intended to be nor should be construed as an offer to enter into a contractual relationship.

7.Contractual Obligations

Except as set out at clause 10 below, Home Sale Online will be under no liability to you whatsoever whether in contract, tort (including negligence), breach of statutory duty restitution or otherwise for any injury, death, damage or direct, indirect or consequential loss (all three of which terms include, without limitation, pure economic loss, loss of profits, loss of business, depletion of goodwill and like loss) howsoever caused arising out of or in conjunction with the use of this Site or the use, accessing, downloading or relying on any or other materials contained in this Site, including, without limitation, as a result of any computer virus.

8. Liability

These terms and conditions do not exclude its liability (if any) to you for personal injury or death resulting from Home Sale Online's negligence, for fraud or for any matter which it would be illegal for Home Sale Online to exclude or to attempt to exclude it's liability.

9. Site Ownership

The Site is owned and operated by Home Sale Online. No material may be copied, modified or distributed in any way, except that you may download one copy of the materials on any single computer for your private use only, provided that you keep intact all copyright and other proprietary notices. The use of any such material on any other website or computer environment is strictly prohibited.

10. Privacy Statement

Home Sale Online operates a privacy policy which can be seen here, this privacy statement forms part of these terms and conditions.

11. Site operated under Scottish Law

The Site is controlled and operated by Home Sale Online from the United Kingdom and is subject to Scottish law. Any dispute concerning these terms and conditions or any of the materials on this Site shall be governed by Scottish law as applied in Scotland and the Scottish courts shall have exclusive jurisdiction to settle any such disputes.

12. Geographical Location

If you are not based in the UK then your use of this Site is without the authority of Home Sale Online which will not be responsible for any loss or liability arising as a result of such unauthorised access.

13. Interruptions And Omissions

In This Service Whilst we take every care to ensure that the standard of this Site remains high and to maintain the continuity of it, the Internet is not always a stable medium, and errors, omissions, interruptions of service and delays may occur at any time. As a result, we do not accept any ongoing obligation or responsibility to operate this Site (or any particular part of it).

14. Invalidity

If any part of our terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

15. Complaints Procedure

We operate a formal Complaints Handling Procedure (CHP). In the first instance complaints should be submitted in writing addressed to The Director, Home Sale Online, The Property Hub, 350 Glasgow Harbour Terraces, Glasgow, G11 6EG. An acknowledgement will be sent to the complainant in writing within 5 working days of receipt of the complaint.

A full response (or if this is not possible, an update) regarding the complaint will be sent to the complainant within 28 days of issue of the acknowledgement. If you are dissatisfied with the response from the company you have the right to refer your complaint to our Independent Redress Scheme. Details of this can be obtained from Home Sale Online.

Please note, the following terms and conditions will apply to all clients.

1. Definition

In these Terms and Conditions the following words and phrases shall mean:

  • Seller or You - The seller of a property as set out above.
  • Buyer - The purchaser of the property.
  • The Property - The freehold or leasehold property which you are intending to sell.
  • 'homesaleonline.co.uk' or 'Home Sale Online', 'HSO' or 'we' means HSO UK Ltd, a Limited Company trading at The Property Hub, 350 Glasgow Harbour Terraces, Glasgow, G11 6EG. Company registration number SC496909.

2.0 Selling Procedures

2.1 We are pleased to provide valuation advice based on the relevant facts known to us including those provided by the seller. No liability is accepted for this advice either to the Seller or to any other party.

2.2 Home Sale Online will carry out a variety of selling procedures aimed at securing interest in the property from potential buyers including advertisements on various property portal sites. Home Sale Online may, from time to time, make changes to the property portal sites they advertise on.

2.3 Home Sale Online shall notify the Seller of all offers to purchase The Property. Unless otherwise advised we will assume that you are the only party to whom offers need to be submitted. Home Sale Online will conduct all offers on a subject to contract basis.

3.0 Terms and Fees

By placing an order, you agree to be bound by these terms and conditions.

3.1 Home Sale Online operates a 6 or 12 month advertising period for our packages dependant on the service provided.

3.2 Home Sale Online will continue to market the property until such times that notice is given to cease marketing by the vendor, the 6 or 12 month marketing period has elapsed or that the property is sold, whichever event occurs first. In any event, any upfront fee paid by you is non refundable. Home Sale Online reserves the right to cancel this agreement with no refund being offered for any upfront fees paid. If you are marketing your property with another estate agent the terms & conditions of their contract must be adhered to and you will have their fees to pay as per their own terms and conditions.

3.3 If we find it necessary to use solicitors or other parties to recover fees and/or costs you will be required to pay any reasonable expenses incurred by us in pursuing the debt.

3.4 Where we agree an appointment to carry out your Home Report and you subsequently cancel on the appointment date or the surveyor cannot gain entry to undertake the inspection, we reserve the right to charge a flat fee of £100 to cover the surveyor's costs.

3.5 If you decide to cancel prior to the inspection being carried out and 7 days after the date of ordering, Home Sale Online will be entitled to retain a flat fee of £50 for expenses reasonably incurred.

4.0 Termination of contract

4.1 Should you wish to withdraw your property from marketing with us, we require our cancellation form to be completed via your account. You will not be entitled to either full or part refund of any upfront fees paid by you to us.

4.2 We can suspend the marketing of your property for one 4 week period, at your request. If the property is suspended for more than 4 weeks a new Home Report and sales package will be required in order to market the property. Our current fees will be applicable at that time.

4.3 Home Sale Online reserves the right to remove your property and remove the provision of our services to any client or the client's representative should any terms and conditions be contravened including offensive and/or threatening behaviour towards any member of staff or preventing staff from carrying out their duties.

5.0 Property Information

5.1 The Seller will endeavour to help verify any of the information requested by us and provide honest and accurate information relating to the property and the sale of the property, including informing Home Sale Online immediately of any material changes in information which may affect the way Home Sale Online markets the property.

5.2 Home Sale Online will prepare the property particulars, however in order to comply with the Consumer Protection from Unfair Trading Regulations Act 2008, Home Sale Online reserves the right not to publish any information provided by the seller.

6.0 Agency Services

6.1 In order to facilitate the sale, Home Sale Online will offer prospective purchasers our full range of estate agency services which may include the valuation or sale of their present property and mortgage and conveyance services of companies not directly attached to Home Sale Online.

6.2 Home Sale Online guarantees that your house is advertised on the website that is www.homesaleonline.co.uk. Third party website portals are subject to change, as they may not be controlled by Home Sale Online and we do not guarantee a continued presence on these websites.

6.3 Viewing requests will be pre-screened and details will be forwarded to the vendor.

The prospective viewer will complete the viewing request form on the property listing page. This will be transmitted to Home Sale Online and we will screen the enquiry and forward to the vendor. The vendor will respond via their account. The vendor will be responsible for confirming and carrying out their own viewings.

6.4 Home Sale Online is unable to market your property until we have a copy of the valid Home Report for the property. Home Sale Online do not impose any restrictions on the Chartered Surveying firm that you choose to produce a Home Report, however the report must not be older than 12 weeks when the advert goes live.

6.5 When purchasing a For Sale board please note that we use a courier to deliver them. We estimate delivery within 5 working days of your advert becoming live. If you are out when they deliver they will leave a card and they will attempt delivery on two further occasions. Thereafter the board and post can be collected from the nearest depots at Glasgow (Paisley), Glasgow (Bellshill), Edinburgh, Aberdeen and Inverness. The For Sale board belongs to you and it is your responsibility to erect it responsibly and securely. The board should not be erected on a neighbour's land or on communal land including the entrances to streets. Local councils can and do remove offending boards and this may incur a fee. If applicable, you will bear the cost of this fee. HSO are not able to replace damaged or missing boards and posts. You can order a new board and post via your account at any time. You are not permitted to erect a board other than the board that we supply. We do not collect the sale boards once the sale is completed. Please ensure you dispose of the board and post responsibly.

6.6 Where possible we will endeavour to respond to all telephone and email enquiries within 1 working day. During busy periods, this timeframe may be exceeded.

7.0 Refunds Policy

7.1 Refunds will be given to clients when errors occur at the point of transaction, for example mistakes at the point of submitting an order. We will refund any money received from you by cheque. Refunds will be processed within 30 days of receiving written notification to cancel.

These Terms and Conditions shall be governed by and construed in accordance with Scottish law and each party hereby submits to the exclusive jurisdiction of the Scottish courts.
